INSURANCE APPROVAL REQUEST FOR COMMERCIAL AVIATION

Article 1 of D.L. No. 2,564, of 1979, which dictates rules on commercial aviation, establishes that the Civil Aeronautics Board (JAC) will establish and control the insurance requirements for the provision of air transport services, whether domestic or international, and all other commercial air navigation services.

In compliance with the above,the JAC issued Resolution No. 604 of 2011 , which establishes that commercial aircraft that provide air transport and aerial works in the country, must be insured for damages to passengers, crew, occupants and for damages to third parties on the surface (third party legal liability), setting minimum amounts and the steps to follow for the approval of such insurances.


Minimum requirements:

For the insurance to comply with the current regulations, the coverage contracted must include the following minimum amounts:

  • For damages to passengers, crew and other occupants who are on board the aircraft for any reason: two thousand (2,000) Unidades de Fomento, or its equivalent in foreign currency, per person.

  • For damage to third parties on the surface: two and a half (2.5) Unidades de Fomento, or its equivalent in foreign currency, for each kilogram of the maximum takeoff weight of the aircraft.

In order to calculate such amounts, the value of the Unidad de Fomento of the insurance's effective start date, and the value of the foreign currency set by the Chilean Central Bank for the first business day of the month when the documentation is submitted before the JAC must be considered.


Procedure:

Operators must prove before the JAC the compliance with the minimum coverage by submitting:

  1. An insurance approval request form in accordance with the type of air operation to be performed. The applicant MUST complete all of the form leaving no blank space.

  2. The documents that support the respective insurance. This can be done by:

    • Submitting the original or a copy of the insurance policy; or

    • Submitting the original or a copy of an insurance or reinsurance certificate issued by the insurance company, containing sufficient information.


The documentation may be sent by email addressed to segurosjac@jac.gob.cl or submitted by hand at the Reception Desk of the JAC located at Amunategui 139, 1st Floor, Santiago.

The Reception Desk receives e-mail requests from Monday through Friday from 9:00 a.m. to 1:00 p.m. All e-mails received after that time will be considered only on the following business day. In case you submit your request by hand, the Reception Desk will be open from Monday through Thursday from 09:00 a.m. to 4:30 p.m. and Friday from 9:00 a.m. to 3:30 p.m.

Insurance approval requests are reviewed in a first in first out method. For this reason, we recommend that you submit your request at least 3 business days in advance of the start date of the planned operations or the expiry of the insurances.

In case objections to your request are made, the JAC will contact the you via e-mail to solve them. Any new documentation or information that is presented MUST be sent to the e-mail segurosjac@jac.gob.cl or submitted before the Reception Desk. Information sent to JAC officials will not be considered in the insurance approval process.

If the submitted insurances comply with the applicable norms, the JAC will issue an approval resolution which will be communicated by e-mail to the applicant and to the Directorate General of Civil Aviation.


Types of operations:

There are four types of commercial operations whose insurances must be approval by the JAC in order to validly operate in Chile.

  1. Operations with large aircraft on scheduled flights

  2. Non-scheduled flights

  3. Operations with small aircraft flights and aerial works

  4. Operations with RPA (drones)
